How to make a claim
If you feel that a pharmaceutical has caused you an unexpected advese effect, you may claim compensation under pharmaceutical injuries insurance. The claim process is started by sending a completed notice of injury form by mail to the Finnish Mutual Insurance Company For Pharmaceutical Injury Indemnities.
Notice of injury form
The quickest way to file a notice of injury is to fill out the electronic notice of injury form on this website. The injury notice need not be accompanied by any receipts or other documentation evidencing the amount of the expenses or size of losses incurred. That will be sorted out once the injury turns out to be compensable.
Who signs the notice of injury
If the claimant is of full legal age, the notice of injury is to be signed by the claimant himself or herself or by a person authorised to sign the notice on behalf of the claimant. If signed by another person, the notice must be accompanied by the relevant authorisation. If the claimant is underage or otherwise incapacitated, the notice of injury is to be signed by the claimant’s guardian. In the case of underage persons, such guardian is usually the parents. If the injured person has died, the notice of injury may be filed and signed by a beneficiary of the death estate.
By signing the notice of injury, the claimant gives consent to the treating institution or another body mentioned in the consent clause of the form to provide the Finnish Mutual Insurance Company For Pharmaceutical Injury Indemnities with the information and documentation needed to handle the claim.
What is the deadline for filing a notice of injury
The deadline for filing a notice of injury is one year from the date that the claimant became aware of the injury caused by the pharmaceutical involved. Yet in no case may a notice be filed later than 10 years after the date at which the claimant stopped taking the pharmaceutical involved.
After assessing the notice of injury, the Claims Unit of the Finnish Mutual Insurance Company For Pharmaceutical Injury Indemnities sends a written decision to the claimant. If the injury is compensable, the decision is accompanied by information as to what kind of compensation or benefits are due under pharmaceutical injuries insurance. The decision is also accompanied by a claim form on which the claimant may detail the items that he or she is claiming compensation for.
